Terms & Conditions

  1. General
    TAXI Botelho & Apollo, De Carvalho Botelho, 7500 St. Moritz GR (hereafter referred to as Taxi Botelho & Apollo) allows guests to book travel services through its online platform
    www.taxi-botelho-apollo.ch or via email.
    These General Terms and Conditions (hereafter referred to as “GTC”) are part of every agreement between guests and Taxi Botelho & Apollo for the provision of travel services.

  2. Drivers
    Taxi Botelho & Apollo provides only trained, professional drivers who speak English, German, Italian, and Portuguese.

    Driver’s working hours – The drivers have a maximum working time of 15 hours, a maximum driving time of 9 hours, and a minimum rest period of 11 hours per day (in rare cases, it can be reduced to at least 9 hours). These are legal requirements for the safety of customers. If necessary, Taxi Botelho & Apollo may assign a second driver for the trip, which would result in additional costs. The price depends on the tasks and distances covered by the second driver.

  3. Reservations
    Reservations can be made according to the instructions on our official website, via email, or by phone (with written confirmation). The reservation is binding as soon as Taxi Botelho & Apollo confirms the booking.

  4. Offers
    If Taxi Botelho & Apollo issues an offer, it is valid for up to 12 hours unless otherwise agreed. There is no guarantee that the offer will be available again at the same price after it expires.

  5. Transfer Trips / Hourly Bookings, Service Changes
    Guests can choose between transfer trips or hourly bookings when requesting their ride.

    If, at the guest’s express request, the actual ride requires additional effort compared to the original request, Taxi Botelho & Apollo will attempt to accommodate it. Additional costs may arise due to the extra effort. Changes to travel arrangements are subject to the availability of Taxi Botelho & Apollo. For transfer services, the price quoted applies to one pick-up and one destination address. Each additional stop or waiting time along the direct route incurs an additional fee based on the current price list.
    Hourly bookings always start at the pick-up time confirmed at the time of booking.

  6. Prices and Services
    The prices agreed upon in advance or noted in the booking confirmation apply. All prices are generally in Swiss Francs (CHF).

  • Included Services:
    Professional driver, vehicle of the booked category or a higher-class vehicle, fuel, operating materials, parking fees, highway, tunnel, and road tolls, vehicle care, car wash, amenities on board (e.g., mineral water), regular expenses of the driver (e.g., telephone, meals, etc.), vehicle and passenger insurance, Swiss VAT of 8.1%.

  • Excluded Services:
    Passenger expenses, extras for the passenger (e.g., tickets or entrance fees), accommodation for multi-day assignments, unagreed extras.
    Special conditions may apply for multi-day assignments and events, which will be mentioned at the time of booking. Exceptions must be discussed prior to confirmation or execution of the order.
    A surcharge of CHF 50.00 is charged per bicycle.

  1. Compensation & Payment
    Key factors influencing the price (including the reimbursement to Taxi Botelho & Apollo for the arranged transport service) are: the vehicle class chosen, the distance, how far in advance the ride is booked, as well as the pick-up time and location.

    Special requests, such as a multilingual driver, customized vehicle branding, additional stops, oversized luggage, etc., can lead to a price increase. (Child seats are free of charge.)
    Special conditions apply for extended services and special vehicles (e.g., rental cars, wheelchair services), as well as for partner company services.

  2. Special Provisions Airport Transfers
    Pick-up is generally with the requested name sign, either directly at the baggage carousel or in the arrivals hall, depending on the airport. The passenger is expected to actively look for the waiting driver (no liability for missed connections). If the passenger cannot immediately identify the driver, there is a duty to cooperate. Before seeking alternative arrangements, the passenger must attempt to contact the driver directly at least once or reach Taxi Botelho & Apollo through the central phone number. Otherwise, all liability is waived, and the trip is considered a “No-Show” and billed accordingly.
    For airport pick-ups, a flat waiting time of 45 minutes is included. Delays (e.g., customs clearance, baggage delivery, shopping, tax-free, lounge stays, restaurant visits, etc.) incur additional costs, and waiting time will be charged according to the price list.

  3. Transfers
    Transfers are generally carried out on the direct route without stops. The choice of route is usually up to the driver. Additional stops or alternate routes can be charged extra. Exceptions include restroom stops at rest areas for longer distances.

    For last-minute or unplanned changes after 10 p.m., an additional fee of CHF 50.00 is charged as a night surcharge for the driver. The driver’s rest periods must be observed.

  4. Vehicles
    Guests can choose from different vehicle classes (e.g., “Mercedes Business Van V-Class”, “Mercedes First S-Class”, “Mercedes Sprinter” or “Special Vehicles”).

    The booked vehicle category is guaranteed. Taxi Botelho & Apollo reserves the right to grant the client a free upgrade or, in exceptional cases, provide a comparable vehicle model. Example: A Mercedes-Benz E-Class was booked, but the service was carried out with a Mercedes-Benz S-Class = upgrade to a higher category at the same price.

  5. Traffic Safety and Luggage
    The price quoted in the booking confirmation includes the number of luggage pieces specified in the booking form. Excess or oversized luggage, or the transport of animals that were not mentioned as additional comments during booking, may result in additional charges. Taxi Botelho & Apollo reserves the right to refuse the transport of luggage and/or animals not agreed upon in advance, especially if the animals are not in a suitable, enclosed transport box.

  • Number of Guests and Luggage Pieces
    The maximum number of guests and luggage pieces specified for a particular vehicle is an estimate based on factors such as the size and weight of the guests and luggage. These are therefore non-binding. Taxi Botelho & Apollo may refuse transport if they believe that space and safety conditions are compromised.

  1. Transporting Children
    Taxi Botelho & Apollo provides free child seats (baby seats, shell seats, booster seats) on board.

    Child seats must be requested during booking. The correct age and weight of the children traveling must be provided to Taxi Botelho & Apollo to ensure the right seats are available. Taxi Botelho & Apollo cannot be held liable for incorrect or missing information.

  2. Refusal of Transportation
    Taxi Botelho & Apollo reserves the right to refuse transport if essential requirements (e.g., according to applicable law) are not correctly provided by the guest in the additional comments.

    If transport cannot be carried out for this reason, it does not affect the guest’s obligation to pay Taxi Botelho & Apollo as per the arrangement contract.

  3. Behavior in the Vehicle
    The following behavior standards apply when guests travel with Taxi Botelho & Apollo:

    – Throughout the ride, all passengers are required to comply with the relevant traffic regulations, particularly the seatbelt requirement. Instructions from Taxi Botelho & Apollo must be followed. It is the responsibility of Taxi Botelho & Apollo to ensure a safe journey. Therefore, passengers are prohibited from opening the doors during the journey, throwing objects out of the vehicle, sticking body parts out of the vehicle, or shouting out of the vehicle (according to OR 41). If a guest wishes to use any of the devices or facilities in the vehicle, a brief instruction by Taxi Botelho & Apollo is required.

    – Smoking and alcohol consumption are prohibited in the vehicle. If the smoking ban is not adhered to, a special interior cleaning (ozone treatment) will be carried out at the end of the service, and the costs will be charged accordingly. Likewise, downtime due to cleaning will be charged.


    – Eating should generally be avoided, except in exceptional situations such as pregnancy, diabetes, etc., where the driver will use his discretion. If ignored, the guest is obligated to pay not only for the vehicle’s cleaning but also for any business downtime resulting from the cleaning.

  4. Delays
    Exceptional situations such as air traffic controller strikes, extreme weather conditions, etc., can only be compensated to a limited extent, and longer waiting times or last-minute cancellations may need to be accepted by guests.

  5. Changes to the Ride
    Advance changes (e.g., date/flight, etc.) are generally possible but may incur an additional fee. Costs will apply if the Taxi Botelho & Apollo vehicle has already left the garage. Once the ride has begun, the guest cannot make any further changes. Costs will be incurred as soon as the vehicle leaves the garage.

    If the trip is spontaneously extended at the guest’s request (route or hours), the actual service (total distance or hours) will be recalculated and priced according to the current pricing structure. For hourly bookings, each additional 30-minute block is billed, i.e., from the first additional minute, a half-hour is rounded up to ensure more reliable planning.
    Accordingly, the guest’s compensation claim increases as Taxi Botelho & Apollo’s expenses for the transportation contract increase in favor of the guest.
    If the distance or hours are shorter than originally booked, the price remains unaffected.

  6. Cancellation of Ride or Hourly Booking
    In the event of a cancellation or rescheduling while the driver is already on the way to the pick-up location and/or less than 4 hours before the ride starts, the full fare will be charged. If the distance or hours are shorter than originally booked, the price remains unaffected. Last-minute changes cannot be guaranteed by Taxi Botelho & Apollo.

  • Cancellation Fees for Limousines and Minivans (up to a maximum of 10 seats) – If the period between the cancellation or rescheduling and the booked ride is less than 24 hours, the cancellation fee is 50% of the agreed booking amount. For less than 12 hours, the cancellation fee is 100% of the agreed booking amount.

  • Cancellation Fees for Small Buses (up to a maximum of 20 seats) – If the period between the cancellation or rescheduling and the booked ride is less than 24 hours, the cancellation fee is 100% of the agreed booking amount.

  • Cancellation Fees for Small Buses (up to a maximum of 10 seats) – If the period between the cancellation or rescheduling and the booked trip is between 48 and 12 hours, the cancellation fee is 50% of the agreed booking amount. If the period is less than 12 hours, the cancellation fee is 100% of the agreed booking amount.

  1. No-Show without Cancellation
    For no-shows, the cancellation fee is 100% of the expected revenue. This also applies to reservations that are not fulfilled due to incorrect booking dates.

    For bookings after 10 p.m., Taxi Botelho & Apollo charges an additional fee of CHF 50.00 for the driver’s night surcharge.
    Special conditions may apply during events (e.g., WEF, etc.) and for multi-day assignments or bookings with multiple vehicles.
    Refunds after cancellation of the reservation will be reduced by 3% due to credit card fees.

  2. Payments
    Credit cards such as American Express, MasterCard, and Visa are accepted.

    To confirm your booking, at least 40% of the total amount is required for each reservation. When you accept our offer via email, you will receive a separate email with payment details.
    Payment can be made via bank transfer or payment link via SumUp and will be confirmed by Taxi Botelho & Apollo in writing via email. The remaining balance is due at the end of the order, payable by invoice, by card to the driver, or in cash.
    In the case of a timely cancellation, the 40% deposit (minus 1%-3% for card fees) will be refunded.

  3. Cross-border Travel
    For cross-border travel, the passenger is responsible for meeting the entry, visa, and/or customs requirements. The driver and/or Taxi Botelho & Apollo cannot be held liable for non-compliance. The same applies to luggage traveling without the passenger and transported solely by the driver.

    When crossing a border, Taxi Botelho & Apollo assumes no liability and declines responsibility for regulations required by the destination country. The guest is responsible for informing themselves about border restrictions and customs regulations and complying with them.

  4. Complaints
    Quality is a top priority at Taxi Botelho & Apollo. If the client is dissatisfied with the services provided, a written and substantiated complaint must be submitted to Taxi Botelho & Apollo no later than 5 business days after the order is completed.

  5. Errors
    Taxi Botelho & Apollo strives to ensure the accuracy and currency of its website, price lists, printed materials, as well as email offers and confirmations. However, despite utmost care, obvious typing errors and mistakes cannot be ruled out.

  6. Liability
    Taxi Botelho & Apollo accepts no liability for force majeure, traffic disruptions, technical failures, incorrect pick-up, and drop-off information (as provided by the guest), or other circumstances beyond Taxi Botelho & Apollo’s control.

    For all disputes arising directly or indirectly from a contractual relationship, the courts in Graubünden have exclusive jurisdiction, and Swiss law exclusively applies.

  7. Complaints
    A complaint arising from an order fulfilled by Taxi Botelho & Apollo should be submitted in writing to “taxi.botelho.apollo@gmail.com”. Taxi Botelho & Apollo will do everything in its power to settle any claims amicably.
